Mechanics liens are available on private projects, such as a subdivision, home, or shopping mall. By obtaining a security interest on the project, you put a lien on the property to ensure that the supplier or subcontractor who has not been paid has a place to go for payment. Public Projects
According to Massachusetts state law, you cannot obtain a mechanics lien on a public project. You can, however, make a claim on the bond, which consists of a performance bond and a payment bond. The performance bond will ensure that the project will be completed, while the payment bond ensures that those who supply the materials and labor will get paid. The payment bond statute specifically allows for the recovery of attorneys fees.
